About these terms

These Terms of Service (“Terms”) govern access to and use of the gazdura.com waitlist landing page (the “Service”) at the pre-launch stage. The Service is operated by Lunar Wave LLC, a Washington limited liability company doing business as Gazdura (UBI 604-248-430). When Gazdura launches the live product, separate Terms will govern that Service.

Geographic scope: the Service is offered to United States residents only at this stage.

1. Acceptance

By submitting an email address to the Gazdura waitlist on gazdura.com, you (“you”) agree to these Terms and to the Gazdura Privacy Policy. You represent that you are at least thirteen (13) years of age, that you are a resident of the United States, and that the email address you submit is your own or one you are authorized to use.

2. Service description

The Service consists of an informational landing page and a waitlist signup form. It does not offer a points-tracking dashboard, alerts engine, payments, user accounts beyond the waitlist record, or travel booking. When the live product launches, separate Terms will govern its use. The waitlist registration itself does not create any right to access the live product on any specific terms.

3. Email-only commitment

Gazdura will send: a single launch-notification email when the Gazdura product becomes available.

Gazdura will not send at the waitlist stage: periodic build-update emails, newsletters, third-party marketing emails, promotional content beyond the launch notification, emails containing hidden tracking pixels, or emails that share your email address with any third party.

If Gazdura introduces additional email categories in the future, Gazdura will (i) update these Terms before doing so, and (ii) require a separate, defaulted-unchecked opt-in checkbox at the relevant collection point. Every email sent will include a one-click unsubscribe link.

4. Cancellation and removal

You may remove your email address from the waitlist at any time by clicking unsubscribe in any email or by emailing ops@gazdura.com from the address on file. Gazdura processes unsubscribe requests within ten (10) business days.

5. Acceptable use

By using the Service, you agree not to:

• Submit an email address that is not your own.
• Submit fraudulent, automated, or bot-generated waitlist signups.
• Probe or scan the Service infrastructure for vulnerabilities except as expressly permitted.
• Interfere with or disrupt the Service.
• Use the Service in violation of any applicable law.

6. Intellectual property

All content on gazdura.com is owned by Lunar Wave LLC d/b/a Gazdura or its licensors and is protected by United States intellectual property laws. Use of the Service does not grant any license to the content beyond viewing for personal, non-commercial purposes.

7. Disclaimers

The Service at the waitlist stage is provided “as is” and “as available.” Gazdura makes no warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or uninterrupted operation. Gazdura makes no representation that the live product will launch on any specific timeline, on any specific terms, or at all.

8. Limitation of liability

To the maximum extent permitted by applicable law, Gazdura is not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Service. Gazdura’s total aggregate liability is limited to one hundred United States dollars (US$100) or the amount you have paid in the twelve (12) months preceding the event giving rise to liability, whichever is greater. (At the waitlist stage, no payments are taken; the practical effect is the US$100 floor.)

Some US states do not allow the limitation or exclusion of certain warranties or damages; in those states, the foregoing limitations apply only to the maximum extent permitted by law.

9. Governing law and dispute resolution

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-laws principles. Disputes shall be brought exclusively in the state or federal courts located in King County, Washington. If you are a consumer resident in a US state (notably California) whose mandatory consumer-protection laws override choice-of-law clauses, your local mandatory rights are not diminished.

10. Changes to these terms

Gazdura may update these Terms from time to time. When Gazdura makes material changes, Gazdura will update the effective date and notify waitlist members by email at least seven (7) days before the changes take effect.

11. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force. These Terms, together with the Gazdura Privacy Policy, constitute the entire agreement between you and Gazdura with respect to the Service.
